theoretically, possessing a medication (even an uncontrolled one like memantine) without a prescription is generally a misdemeanor. selling a prescription medication (even uncontrolled ones) without a medical/pharmacy license will run that up into a felony.
now, probably wouldnt get taken as seriously by the 5-0 as controlled meds, nor would there be as many resources put into stopping it but just because it’s uncontrolled doesn’t make it legal. schedule IV, V, and unscheduled meds don’t get treated nearly as seriously. it’s why it’s so easy to find vendors for m0d@finil and S0m@ and the like, the law doesn’t put as many resources towards it.
it’s still, in fact, pretty illegal. it’s just not taken nearly as seriously as Schedule I, II, and III drugs.
